The following updates have been made to the Terms and Conditions:

Clause 2.2 has been updated to facilitate the use of 365 Phone and Digital Banking by a wider variety of customers (for example, clubs, associations, societies and partnerships) and clarifies that notifications to the change of identity of a user of 365 Phone and Digital Banking must be made on a specific notification form that is available at any Bank of Ireland Branch.

The following updates are being made to the Terms and Conditions:

Clause 2.2 has been updated to reflect changes brought in by the ‘Companies Act 2014’ and to clarify the role of a user of 365 Phone and Digital Banking
Clause 7.0 has been updated to clearly call out the authority and obligations of joint account holders
Clause 10.0 has had the references to IRECC removed as it is now closed
Clause 16.0 (a) has had the correspondence address for the Customer Care Unit updated
Clause 22.0 has been updated to reflect changes being made to the eStatements functionality. All customers will automatically have access to eStatements for their eligible accounts in 365 online and will have paper delivery of these documents turned off. Customers can at any time opt to be provided with paper documents and statements by editing their Statement preferences in 365 online
Bank of Ireland would also like to remind customers of the following:

Where we notify you of any change to the Terms and Conditions that you do not wish to accept, you may, without charge, end your use of 365 Phone and Digital Banking by notifying us on 0818 365 365.

If you do not notify us that you wish to end your use of 365 Phone and Digital Banking, you are deemed to have accepted the changes on their effective date. In this instance, the effective date of the change is 17th November 2015.

To facilitate the offering of 365 Phone and Digital Banking to certain Limited Companies, clause 2.2 was added to the Terms and Conditions in February 2015, some small clarifications have been made to this clause in the Terms and Conditions.

2.2 If you are a business customer:

(a) it is your sole responsibility to select and appoint a person to use these services and you must satisfy yourself as to the suitability and integrity of the person chosen;
(b) you agree that we shall not be liable to you or anyone else for any loss or expense as a result of us acting on the instructions of the person chosen by you to use these Services;
(c) any change in the identity of the person authorised to use these Services must be notified to us in writing by any two directors or all equivalent authorised signatories (in the case of unincorporated bodies) on headed notepaper. Such notification will be treated as effective by us from the time of receipt;
(d) you authorise us to (but we do not have to) suspend transactions on the account where in our sole discretion we reasonably believe we have (i) unclear authority from you or the person authorised to use the Services on your behalf or (ii) contradictory instructions in relation to the operation of the Services or the Account from two or more of the Directors, Secretary, officials or persons whom we believe to be in a position of authority and we are authorised to maintain this suspension until you give a new and clear authority in a form acceptable to us. This Clause 2.2(d) is an exception to Clause 2.2(c); and
(e) some of the Services forming part of 365 Phone and/or Digital Banking may not be available to you, as we may advise you from time to time.

To facilitate the introduction of a number of developments for Bank of Ireland customers, Bank of Ireland is updating its 365 Phone, Online and Mobile Banking Terms & Conditions which will come into effect on 20th August 2014.

Bank of Ireland Tablet Banking App

A new Tablet Banking App will enable Bank of Ireland 365 online registered customers to access online banking services while on the go using a tablet device. Full details relating to Bank of Ireland Tablet Banking are set out in Clause 24 of the updated Terms and Conditions.

eStatements

eStatements will be made available for additional account types (credit card, loan & term accounts) and other account documentation, such as the pre-notification of interest & fees, will be available electronically.

Bank of Ireland Life Policies

Additional Bank of Ireland Life policies can be displayed online for Bank of Ireland 365 online registered customers. Further details relating to these policies are set out in Clause 3 of the updated Terms and Conditions.

Additional Changes to Terms and Conditions

In addition to the changes set out above and a number of other non-material updates,the following changes will be made to your Terms and Conditions:

‘Definition of Terms’ (Clause 1) updated to include ‘Bank of Ireland Tablet Banking’, ‘Digital Banking’, ‘Policy’, and ‘Security Credentials’
Removal of ‘Mandates’ (Clause 3)
Additional information called out in ‘Security and Authentication’ (Clause 5), ‘When we Act on your Instructions’ (Clause 6) and ‘Your Responsibilities’ (Clause 14)

For the purposes of the implementation of the SEPA (Single Euro Payments Area) regulation, the following information will be added to your 365 online Terms and Conditions and will come into effect on 25th November 2013.

Direct Debit Services

Where your Direct Debit operates under the SEPA Direct Debit Scheme, we will provide a series of Direct Debit Services – covered under clause 10.
Changes to Money Transfer

References to SEPA and the following payment types have been updated where appropriate:

SEPA Transfers are electronic transfers of euro by you from your Account to a designated account within the SEPA Zone. These include payments formerly known as Domestic Transfers and certain International Transfers.
International (Non SEPA) Transfers are non-euro electronic payments by you from your account to a designated account outside the Republic of Ireland or a euro payment to a designated account outside the SEPA zone. These include certain payments formerly known as International Transfers.
Reference to the use of a sort code and account number update to now include a reference to the use of a BIC and IBAN.
In addition to the SEPA changes set out above, the following clause will be made:

The intentional breach of Terms and Conditions in clause 14.3 (c) has been called out to bring customer liability in line with the Payments Services Regulations.

The inclusion of Clause 25 entitled ‘Pay to Mobile’ to cover the addition of the new Pay to Mobile service on the Bank of Ireland Mobile Banking App which allows registered customers to send and receive payments using a mobile phone number. The clause includes the following:

You agree that when we process your Pay to Mobile payment, we rely on the payee’s mobile number only. It is your responsibility to ensure that the mobile number is correct.
You authorise us to disclose your mobile number to any payee for the purpose of administering any Pay to Mobile payment.
You consent to the Bank of Ireland Mobile App accessing data in the address book of your mobile device, if you select a contact number from your address book.
